Legal and Commercial Mandate of the BCV Rate
Under Venezuelan financial regulations administered by the National Superintendence for the Defense of Socioeconomic Rights (SUNDDE) and the Central Bank of Venezuela, commercial merchants and businesses are legally obligated to use the official BCV rate when converting prices published in foreign currencies (such as US Dollars) into Venezuelan Bolívares at the point of sale.
The BCV calculates this rate by computing the volume-weighted average of all purchase and sale operations performed across authorized universal and microfinance banking tables throughout each business day. It remains effective until the conclusion of the subsequent banking session.
How the "Mesas de Cambio" Interbank System Operates
Since Exchange Agreement No. 1 (Convenio Cambiario N° 1) came into effect in September 2018, Venezuela replaced its previous rigid currency control system (CADIVI / CENCOEX / DICOM) with interbank exchange desks known as "Mesas de Cambio":
- Commercial Bank Participation: Universal banks (Banco de Venezuela, Banesco, Mercantil, BBVA Provincial, Bancamiga, etc.) operate digital trading desks where retail clients and corporations place purchase and sale bids.
- Weighted Average Calculation: At the close of each banking day (around 4:00 PM VET), each institution reports its transacted volume and effective exchange rates to the BCV. The central bank weights these transactions by total volume to establish the legal closing benchmark.
- Validity Period: The closing rate published on Friday afternoon remains the legally mandatory benchmark throughout Saturday, Sunday, and any national banking holidays until the next business day concludes.
Consumer Rights and SUNDDE Protections
Venezuelan consumers possess legal rights when executing retail purchases:
- Merchants cannot charge higher exchange rates than the published daily BCV rate.
- Merchants cannot impose debit card surcharges or extra percentage fees for paying in Bolívares.
- Violations can be reported to SUNDDE via telephone hotline (0800-LOJUSTO) or official digital channels.
